Being pursued by debt collectors is a stressful experience for anyone. Unfortunately, many debt collection companies use bullying, harassment, inaccurate debt reporting, and misdirection to get money out of their clients. With such shady activities going on, it’s no wonder debt collection companies like Dominion Law Associates have a bad name.

I learned more than I ever wanted to know about debt collection firsthand a few years ago. Dominion Law Associates purchased one of my old debt accounts and proceeded to badger me for payment on the debt. The debt was an auto loan, and according to Dominion Law Services, the balance due was over $15,000. That simply didn’t match what I showed in my records from my old creditor. I told Dominion Law Services I wasn’t going to pay, and that’s when the real trouble began.

If you find yourself suffering harassment from a debt collection company like Dominion Law Services, you need to understand the tactics they will use against you, as well as your rights.

Here are a few of the tactics commonly used by debt collectors:

-Harassment. Debt collectors will send you piles of mail and call your home on a daily basis. This is the most common complaint people have against debt collectors.

-Shame. In some cases, debt collectors will even call your employer looking for you. By doing this, the debt collectors hope to shame you into paying by embarrassing you at work.

-False Rapport. If the debt collectors are able to get you on the phone, they will often try to convince you that they have your best interests at heart. They will propose a payment plan, and hope that you will be naive enough to accept it. Once you begin paying on a debt, it can be much more difficult to dispute later.

-Interest and Fees. By causing your debt to grow at an alarming rate, the collection agency hopes to convince you to start paying before things can get any worse.

-Damaged Credit. If you refuse to pay, the collection agency will begin reporting your debt to the credit bureaus. Of course this is very damaging to your credit. Each collection item can lower your credit score about 100 points.

-Lawsuits. Some debt collection companies will attempt to take you to court to settle the debt. Again, in some cases this is an intimidation technique. Don’t assume that there is a strong case against you, just because the debt collector claims to be willing to go to court. Many consumers have reported that Dominion Law Associates attempted to sue them for collection of inaccurately reported or expired debts.

According to complaints lodged against Dominion Law Services, in addition to all of these common tactics for debt collection, Dominion also misuses consumers’ personal information and fails to adhere to payment plans. Some individuals have reported that they agreed to one payment rate on the phone with Dominion, only to have the company come back later and demand a higher rate. Another individual claims that Dominion improperly withdrew funds from their bank account.

I also had trouble with Dominion Law Services. Per their common practices, they sent me weekly letters, called my home on a daily basis, and reported my collection item to all three credit bureaus. Soon my credit had dropped over 100 points! I was out of work at the time, and I knew that I needed to protect my good credit in order to find a new job. Nowadays, it’s pretty common for employers to look at credit reports before making hiring decisions. I certainly didn’t want my plummeting credit scores to influence potential employers or prejudice them against me.

If you let them, debt collectors have a way of making you feel powerless and hopeless about your situation. I tried to mentally resist this and remain positive about everything, but it was pretty difficult. I realized resolving to fight back against Dominion Law Services in whatever way I could wasn’t enough. I needed a plan.

I did some research, and learned about the tactics that people like you and me can use against debt collectors:

-Refuse to Engage. It is not in your best interests to try to befriend your debt collector. Agents of Dominion Law Services are professionals, and they are not going to be swayed by your sad story of how you got tangled up in bad debt. Debt collectors work on commission, so they only get paid when you pay. You’re just entry on a balance sheet to them. By calling you incessantly, debt collectors hope to badger you into submission and make you lose the will to defy them. Don’t give them an opportunity to do that. Just hang up the phone!

-Put it in Writing. When dealing with debt collectors, it is important to have a written record of all communications. If you want to dispute your debt, don’t do it over the phone. Instead, write a letter. Better yet, have a lawyer write the letter for you.

-Initiate Debt Validation. If you are being pursued for collection on a debt, bear in mind that it is not your responsibility to prove you are innocent. Rather, the debt collection agency is legally obligated to prove that you are guilty. By initiating the debt validation process, you force them to provide that proof. If they can’t prove you owe the debt, the debt will be absolved.

-Investigate the Statute of Limitations. Debt collectors cannot legally collect on debts that have exceeded the statute of limitations in your state. Never pay a debt collector until you have first made sure that the statute of limitations has not yet run out. If you do pay, you could restart the statute of limitations and end up responsible for you expired debt again.

-Check your Credit Report. If the collections agency has begun reporting your debts to the credit bureaus, carefully check the information that is now on your record. If anything has been reported inaccurately, you can exercise your rights under the Fair Credit Reporting Act and get the collection items removed.

-Hire a Professional. Ultimately, the very best thing you can do to fight back against debt collectors like Dominion Law Services is to hire a professional to investigate your case and represent your interests.
